1. ACCEPTANCE OF TERMS
By accessing, browsing, or using the website located at www.farmsetpacific.com (the “Site”), or by purchasing products and services from Farmset Limited (“the Company,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease use of this Site and our services. These terms apply to all visitors, users, farmers, commercial entities, and others who access the Site or engage in transactions with Farmset Limited.
2. COMPANY INFORMATION
Farmset Limited is a 100% Papua New Guinea-owned enterprise, established in 1969. Our registered head office is located at Airport Road, Goroka, Eastern Highlands Province, Papua New Guinea. We operate a network of branches across PNG and a retail outlet in Honiara, Solomon Islands.
3. PRODUCTS AND SERVICES
Farmset Limited provides a wide range of agricultural solutions, including but not limited to:
AgriFeed: Stockfeed (Namba 1 brand), poultry, and porcine feeds.
Machinery & Tools: Chainsaws, brush cutters, tractors, generators, and sawmills (including brands like Husqvarna, Lucas Mill, Hi-Earns, and Kubota).
Chemicals & Fertilizers: Pesticides, insecticides, herbicides, and soil nutrients.
Technical Support: Maintenance, repair services, and training programs.
While we strive for 100% accuracy, Farmset Limited does not warrant that product descriptions, photographs, or pricing on the Site are accurate, complete, reliable, current, or error-free.
4. PRICING AND PAYMENT
Currency: All prices quoted are in Papua New Guinea Kina (PGK) unless otherwise specified.
Adjustments: Farmset Limited reserves the right to change prices at any time without prior notice due to market fluctuations, changes in duty, or supplier costs.
Taxes: Prices are subject to Goods and Services Tax (GST) as per the laws of Papua New Guinea or the Solomon Islands, as applicable.
Payment Terms: For online inquiries or orders, payment must be cleared before the dispatch of goods unless a prior credit arrangement has been formally approved in writing by our finance department.
5. USE OF AGRICULTURAL CHEMICALS AND MACHINERY
Critical Safety Warning: The purchase and use of agricultural chemicals (pesticides, fertilizers) and heavy machinery (chainsaws, sawmills, tractors) involve inherent risks.
Compliance: Users must comply with all local environmental and safety regulations.
Instruction: By purchasing these items, you agree to read all manuals and safety data sheets (SDS) provided. Farmset Limited is not liable for damages resulting from the misuse, improper storage, or unauthorized application of chemicals or equipment.
Training: We highly recommend attending our farmer training and awareness programs before operating specialized machinery.
6. INTELLECTUAL PROPERTY RIGHTS
The content on this Site, including text, graphics, logos, images, and software, is the property of Farmset Limited or its content suppliers (e.g., Husqvarna, Lucas Mill) and is protected by international copyright and trademark laws. You may not reproduce, duplicate, copy, sell, or otherwise exploit any portion of the Site for commercial purposes without express written consent from Farmset Limited.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Farmset Limited shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, crops, livestock, or data, arising out of:
The use or inability to use the products purchased.
Errors or omissions in technical advice provided by our consultants.
Delays in delivery due to logistics in remote regions of PNG or the Solomon Islands.
Force Majeure events (natural disasters, civil unrest, or shipping strikes).
8. WARRANTY AND RETURNS
Manufacturer Warranty: Machinery and equipment are generally covered by the manufacturer’s warranty. Farmset Limited acts as a facilitator for these claims.
Inspection: Customers must inspect goods upon delivery or pickup. Claims for damaged or missing items must be made within forty-eight (48) hours of receipt.
Exclusions: No returns or refunds will be accepted for opened chemical containers, custom-mixed feeds, or equipment that has been modified or repaired by unauthorized third parties.
9. DELIVERY AND LOGISTICS
Farmset Limited utilizes a distribution network centered in Lae to serve our 10+ branches.
Risk of Loss: The risk of loss and title for items pass to the customer upon delivery to the carrier or upon pickup from a Farmset branch.
Remote Access: While we strive to reach all rural sectors, delivery times to remote Highlands or Island regions are estimates only and are subject to local infrastructure conditions.
10. USER CONDUCT
When using the Site or interacting with our social media platforms (Facebook, TikTok, etc.), you agree not to:
Post fraudulent, defamatory, or unlawful material.
Attempt to bypass Site security or introduce viruses.
Misrepresent your identity or affiliation with any farming cooperative or commercial entity.
11. PRIVACY POLICY
Your use of the Site is also governed by our Privacy Policy. We collect information necessary to process your orders and provide technical support. We do not sell your personal data to third parties.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Farmset Limited, its officers, directors, employees, and shareholders from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these terms or any activity related to your account or the use of our products.
13. GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of the Independent State of Papua New Guinea. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Goroka or Port Moresby.
14. AMENDMENTS
Farmset Limited reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or our services constitutes your acceptance of the revised terms.
